Yes, you are free to fire your attorney at any time if you
are dissatisfied with their performance.
What will happen depends on some of the specific factors in your
situation. First, it depends whether
your case is in the negotiation stage (pre litigation) or in litigation (an
already filed lawsuit). Second, is it a
contingency fee case or hourly? If it is
hourly, then you don’t have to do anything; if it is a contingency fee case,
then they may be entitled to a portion of the recovery depending on what stage
of the case it is. Third, it depends on
the terms of the representation agreement you signed with your attorney. If it does not mention what will happen in
the event of termination, then the lawyer will only be able to recover on a
theory of “quantum merit”, which allows them to recover for the work they
performed.
